1. Who we are

These Terms of Service ("Terms") are a legal agreement between you and Lustermount LLC, a Wyoming limited liability company located in Wyoming, United States ("Lustermount," "getwhitebg," "we," "our," or "us"), governing your access to and use of getwhitebg.com and related services.

If you use the service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least 13 years old to use the service. If you are between 13 and the age of majority in your jurisdiction, you may use the service only with the involvement and consent of a parent or legal guardian. You may not use the service if applicable law prohibits you from doing so.

3. Service description

getwhitebg.com provides online tools that process compatible image uploads, remove backgrounds, place products on white-background canvases, generate exports, and make those exports available through single-image and batch workflows.

The service is designed to support ecommerce image preparation. It does not guarantee marketplace approval, policy compliance, search placement, revenue, conversion, or any business result.

4. Accounts and authentication

Certain features require an account. Based on the current product implementation, Google sign-in is required before upload and export. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate account information and promptly update it if it changes. We may require re-authentication, identity verification, or additional information when reasonably necessary to protect the service, investigate fraud, or process support and billing requests.

5. Acceptable use

You agree not to use the service for unlawful activity, harmful content, or content you do not have the right to process.

• upload or process content that infringes intellectual property, privacy, publicity, or other rights
• upload malware, harmful code, or content intended to disrupt systems or users
• attempt to reverse engineer, probe, scrape, overload, or bypass technical safeguards or access restrictions
• use the service for deceptive, fraudulent, abusive, or illegal activity
• misrepresent your identity, affiliation, or rights in uploaded content
• use automated means to access the service in a way that interferes with normal operation

6. Your content and responsibilities

You retain ownership of the images and content you provide. By uploading or submitting content, you grant us and our service providers a limited, non-exclusive, worldwide license to host, store, transmit, process, reproduce, and transform that content only as necessary to operate, secure, maintain, and improve the service.

You are solely responsible for the content you upload, the rights you have in that content, the markets where you use exported files, and verifying that any export meets your own marketplace, policy, contractual, and brand requirements.

7. Service availability and changes

The service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features at any time.

We do not guarantee uninterrupted availability, error-free operation, permanent storage, or that every processed image will be suitable for your intended use. Maintenance, provider outages, fraud review, abuse prevention, and infrastructure issues may temporarily affect access or performance.

8. File handling and retention

Image uploads are processed through third-party image processing providers. We retain uploaded files, generated outputs, task history, and export records for up to 30 days.

• we do not currently offer self-serve deletion for in-product image history

We may delete or disable access to content sooner if required for security, fraud prevention, legal compliance, abuse response, technical operations, or provider limitations.

9. Payments, credits, refunds, and chargebacks

getwhitebg sells credits for exports. Pricing, credit pack descriptions, and any public free-export allowance are shown on the website and may be updated from time to time.

• credit purchases are non-refundable except for duplicate charges or confirmed payment errors
• credits are consumed according to the product rules in effect at the time of export
• failed export attempts are not intended to consume credits
• taxes, VAT, duties, bank charges, and currency conversion fees are your responsibility unless applicable law requires otherwise

If you initiate a chargeback, payment dispute, or reversal without first contacting support where reasonably possible, we may suspend credits, exports, downloads, or account access while the dispute is under review. We may recover reversed amounts, dispute fees, and associated costs to the extent permitted by law and our provider arrangements.

10. Third-party services

The service relies on third-party providers for core functions. These may include Stripe for hosted checkout and payment processing, Google sign-in, Supabase-based authentication and data infrastructure, Vercel Analytics and Vercel Speed Insights, and third-party image processing providers selected by the service.

Your use of third-party services may also be subject to those providers' terms, privacy notices, and operational rules. We are not responsible for third-party systems, outages, policy changes, or data handling after information is lawfully transmitted to them on your behalf.

11. Intellectual property

Except for your content and the limited rights expressly granted in these Terms, Lustermount LLC retains all rights, title, and interest in the service, website, branding, software, design, text, graphics, and related materials.

You may not copy, resell, distribute, modify, or create derivative works from the service itself except as permitted by law or with our written permission.

12. Suspension and termination

We may suspend, limit, or terminate your access immediately if we reasonably believe that you violated these Terms, created legal or security risk, engaged in fraud or abuse, interfered with the service, failed to pay required charges, or if suspension is necessary to comply with law or provider requirements.

You may stop using the service at any time. Termination does not affect rights or obligations that accrued before termination, including payment obligations, dispute rights, or sections of these Terms that by their nature should survive.

13. Disclaimers

The service is offered for general business and informational purposes. We do not provide legal, compliance, tax, accounting, or marketplace approval advice. You should independently review exported files, listing requirements, and platform policies before publication or commercial use.

To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.

14. Limitation of liability

To the fullest extent permitted by law, Lustermount LLC and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, data, goodwill, or use, arising out of or related to the service or these Terms.

To the fullest extent permitted by law, Lustermount LLC's total aggregate liability for claims arising out of or relating to the service or these Terms will not exceed the greater of (a) the amount you paid us for the service in the 12 months preceding the event giving rise to the claim, or (b) USD $100.

15. Indemnification

You agree to defend, indemnify, and hold harmless Lustermount LLC, its affiliates, personnel, and service providers from and against claims, liabilities, damages, judgments, losses, and costs arising out of or related to your content, your use of the service, your violation of these Terms, or your violation of any law or third-party right.

16. Governing law and dispute resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Wyoming, United States, and you consent to the personal jurisdiction and venue of those courts.

17. Policy updates

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when changes were last made. Changes become effective when posted unless a different effective date is stated. Your continued use of the service after updated Terms take effect constitutes acceptance of the revised Terms.

19. Entire agreement

These Terms, together with any policies and pricing pages expressly incorporated by reference, constitute the entire agreement between you and us regarding the service and supersede prior understandings on the same subject matter.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision.
